Limitation of Liability: The amount of any loss or damage for which RD Delivery Inc. or its agents may be liable, shall not exceed $2 per pound ($4.41 per kilogram) computed on the total weight of the shipment not to exceed $250 unless a higher value is declared on the face of the bill lading by the consignor and it is further agreed as a special agreement, and not withstanding any disclosure of the nature or extraordinary value of the goods, the amount of any loss or damage including without limitation, consequential, incidental or indirect damages including loss of earnings or profits, in any manner resulting whether or not from negligence or gross negligence, from loss or damage to the goods and/or misdelivery, failure to deliver or delay in the delivery of the goods, or which RD Delivery Inc. may be liable to the consignor, owner, consignee and/or any third party whether in contact, tort or otherwise, shall in no event exceed in the case of fundamental breach by the carrier, the greater of an amount equal to RD Delivery Inc’s. maximum liability aforesaid and the amount of all freight and other charges paid hereunder, and in any other case, an amount equal to RD Delivery Inc’s maximum liability aforesaid.

Notice of Claim: No carrier is liable for loss, damage or delay to any goods carried under the Bill of Lading unless notice thereof setting out particulars of the origin, destination and date of shipment of the goods and the estimated amount claimed in respect of such loss, damage or delay is given in writing to the originating carrier or the delivering carrier within thirty (30) days after the delivery of the goods, or, in the case of failure to make delivery, within nine (9) months from the date of shipment. Amount claimed should reflect the wholesale value of the goods in order to assess the RD Delivery Inc’s. liability if any. The original invoice(s) must be submitted as proof.

When initiating a claim for Damaged Material, " Customer" must provide, at a minimum, the following information to RD Delivery Inc.: date of shipment, damaged contents and the original packaging statement and/or invoice indicating the wholesale cost of goods claimed to be damaged, all shipper and consignee information, and any other relevant information that would substantiate the claim.

When initiating a claim for Lost Material, "Customer" must provide, at a minimum, the following information to RD Delivery Inc.: date of shipment, letter of claim, detailed description of lost good(s), statement and/or invoice indicating the wholesale cost of goods claimed to be lost, all shipper and consignee information, and any other relevant information that would substantiate the claim.

Late Delivery Policy: Although we strive to achieve punctual service, delivery times may exceed the scheduled service times. Consequently, we do not guarantee our service times and assume no liability for any loss of profit, income, interest, attorney’s fees, or any special, incidental or consequential damages resulting from a late delivery.

Additional Coverage: Declared value in excess of $100 will be charged at $3 per $100 or portion thereof. Maximum accepted liability of $50,000.

Force Majeure Clause:  The on-time delivery guarantee does not apply to the shipments that are delayed to causes beyond RD Delivery Inc’s. control, including, but not limited to, the following: the unavailability or refusal of a person to accept delivery of the shipment, delays caused by the consignee, acts of god, public authorities, riots, strikes or other labour disputes, civil commotions, disruptions in the ground transportation network (such as extraordinary weather phenomena), and natural disasters.

Service Charges: Tariff charges will be levied if a pick up is not available for whatever reason (unless canceled before driver is on route). Additional charges will be assessed for re-direct shipments and returned packages.

Tracing: Verbal and/or written proof-of-delivery will be provided if requested at time of delivery to RD Delivery Inc.

Suspension of Service: RD Delivery Inc. reserves the right to suspend service should the customer’s account have an unpaid balance outstanding greater than 60 days.

NSF Charge: RD Delivery Inc. will levy a $35 charge for every NSF cheque.

Dangerous Goods: Will not be accepted.

Taxes: All applicable Federal and Provincial Sales Taxes required by law will be charged on all net freight costs.

No Pick Up: Tariff charges will be levied if a pick up is not available for whatever reason (unless canceled before driver is on route). Additional charges will be assessed for re-direct shipments and returned packages.
